Terms of Sale

Shipping is quoted at checkout per carrier (Correos / SEUR / UPS) via Packlink PRO. Payment is
by bank transfer today; the Stripe gateway application is pending. §7 below is the section that
most needs a lawyer’s eye
— it takes a position on the right of withdrawal for live plants that
is defensible but not risk-free.

1. Who you are buying from

Sanson Berriedale Johnson, trading as San Pedro Shop, an empresario individual (autónomo) resident in Spain,
NIF X3316772B, of Calle Sorolla 14, 03560 El Campello, Alicante, Spain.
Contact: info@sanpedro.shop. See our Legal Notice.

2. What we sell

Live ornamental and collector cacti — rooted plants, cuttings, seeds and grafted specimens — plus
growing supplies. Everything is sold strictly for ornamental, horticultural and collector purposes;
our Ornamental Use Disclaimer forms part of these terms and you accept it when you
order.

Living goods vary. Photographs show representative examples of our stock. The specimen you
receive will differ in size, form, colour and spination from the one photographed. Cuttings are cut
to order from garden stock. Minor blemishes, scarring and colour variation are normal features of a
field-grown plant and are not defects.

Cuttings are supplied in 40 cm pieces. Larger orders are supplied as a greater number of 40 cm
cuttings, not as longer single pieces — this is how the material travels safely, and each piece
roots independently. A pack described as three cuttings supplies approximately 1.2 m in total.

3. Prices

Prices are in euros and include Spanish IVA where applicable. Shipping is calculated at checkout
and shown before you confirm. You choose the carrier (Correos, SEUR or UPS) at checkout and the
price is quoted for the service you pick.

We may change prices at any time, but never after you have placed an order.

4. Placing an order

Your order is an offer to buy. A contract is formed when we send you an order confirmation email.
If we cannot supply an item — stock is finite and grown, not manufactured — we will tell you and
refund it in full.

We may decline an order where we cannot lawfully ship to the destination (see §9).

5. Payment

Payment is by bank transfer (Revolut). We prepare your order once the funds clear in our account.
An order is held for 7 calendar days from confirmation to allow for transfer; if funds have not
cleared by then, the order is cancelled and any items released. Card payment will be offered once
our gateway application is approved.

6. Delivery

We dispatch from Spain. At checkout you select a carrier — Correos (approximately 3 working days),
SEUR (approximately 4 working days) or UPS (approximately 2–3 working days) — and the quote for
that service is shown before you confirm. Delivery times are typical, not guaranteed.

Plants are cut or lifted close to dispatch so they travel in the best condition possible. We do not
dispatch immediately before weekends or public holidays where that would leave a parcel in transit
over several days, and we may delay dispatch during extreme heat or frost to protect the plant. We
will tell you if we do.

Risk passes to you on delivery.

7. Right of withdrawal — please read

Under Spanish consumer law (Real Decreto Legislativo 1/2007), a consumer buying at a distance
generally has 14 days from receipt to withdraw without giving a reason.

That right does not apply to some of what we sell. Article 103 excludes, among others, goods
made to the consumer’s specifications and goods liable to deteriorate or expire rapidly. Our
position is:

Product Withdrawal right
Cuttings (cut to order, perishable) Excluded — Art. 103(c) and (d)
Seeds (sealed packet, unopened) 14 days, if the packet is unopened
Rooted and potted plants 14 days apply. Return in the condition received, at your cost
Growing supplies (unopened) 14 days

⚠️ For the lawyer: the exclusion claimed for cuttings rests on their being both cut to order
and perishable. That is a reasonable reading, but it is a position, not a certainty, and it is the
single most consequential legal call in this document. Please confirm or correct it before
publication. The safer commercial fallback, if the exclusion does not hold, is to accept
withdrawal but not to refund outbound shipping on a perishable good.

Withdrawing does not affect your rights below if something arrives damaged or not as described.

8. If your plant arrives damaged

Live plants occasionally suffer in transit. If yours arrives damaged, crushed, frozen or rotting:

  • Tell us within 48 hours of delivery, at info@sanpedro.shop.
  • Send photographs of the plant and of the packaging as received.

We will replace it, or refund it, at your choice. This is in addition to, and does not limit, your
statutory rights, including the legal guarantee of conformity.

We cannot help with a plant that has declined after arrival through care — cacti are sensitive to
overwatering, and our care guide covers the first ninety days. That is not a defect in the
goods.

9. Where we ship

We ship only where these plants may lawfully be sold and possessed. By ordering, you confirm that
purchase and possession are lawful where you live.
We may cancel and refund any order we believe
cannot lawfully be fulfilled.

For destinations outside Spain, cross-border shipment of certain species may require phytosanitary
or CITES documentation. Where applicable we will arrange this before dispatch, and we will cancel
and refund the order where it cannot lawfully be arranged.

10. Complaints and disputes

Write to info@sanpedro.shop and we will try to resolve matters directly. If we cannot, you may
approach your local consumer information office (OMIC) or the consumer arbitration system
(Sistema Arbitral de Consumo). These terms are governed by Spanish law, and nothing in them removes
any right you have as a consumer that cannot be excluded by agreement.
